A breakdown of what EU non-compliance with packaging, plastic, supply-chain, and digital-asset rules actually costs — and why our verification shield is no longer optional for any company exporting into the bloc.
"NLD" = Non-Liable / Non-Documented. When you cannot prove the origin, recycling rate, or compliance status of plastic moving through your supply chain, you are NLD. In Europe in 2026, NLD = destruction — of margin, of market access, of brand permission to operate.
The EU has shifted from soft guidance to enforced obligation across five vectors at once: PPWR, CBAM, DPP, MiCA, LkSG. Together they form an interlocking lattice. Miss one, the others tighten around you.
| Regulation | Trigger | Penalty Range |
|---|---|---|
| PPWR (EU Packaging Reg.) | Unverified recycled-content claim | €10k–€500k per SKU |
| VerpackG (Germany) | Failure to register / report | up to €200k per breach |
| Afvalfonds (Netherlands) | Late or wrong reporting | €5k–€100k + back-charge |
| CBAM (Carbon border) | Unverified embedded-carbon claim | €50–€100 per tonne CO₂eq |
| LkSG (Germany supply chain) | No due-diligence audit | up to 2% global turnover |
| DPP (Digital Product Passport) | Missing passport on regulated SKU | market exclusion |
| MiCA (digital assets) | Unauthorised token issuance to EU | up to 5% global turnover |
| Reputation (greenwashing) | Class action / NGO campaign | unbounded |

Each layer of the shield maps directly to one regulatory teeth. See /epr-shield for the full operational doctrine and MD-464 for the European compliance frame.
Three things converge in 2026:
The window to be the verifier-of-record into EU narrows when EU-native incumbents land their own version. First mover gets the regulatory recognition, the partnership channels, and the brand permission. Late mover competes on price against subsidised local players.
NLD Destruction is the bottom-of-funnel argument. Every conversation with a target enterprise (see EU Target Companies) opens with the relationship — but closes with this page. The shield is what they're buying. The dPRN is how it's delivered. The Node Hub is where it all lives.
"NLD = Non-Liable, Non-Documented = Destruction. In the new Europe, what you cannot prove, you cannot sell. Our verification shield turns regulatory teeth into your moat."
